We offer a full in-house packaging service. We aim to deliver items to you within four working days of the sale. We charge £7 per 10 minutes for staff time, packing material and delivery to the Post Office. The minimum amount is €6 plus VAT.
Dispatched by Royal Mail Special Delivery (next day before 1pm, tracked). If customers need an alternative service, we must be notified by email. Customers who are new to our service are encouraged to call our office to make arrangements

Auction of houses and interiors

For short-distance delivery, we can provide you with the names of couriers who can assist you.

For longer distances we recommend Martin Bros Removals Ltd who collect from us every week. We can give you a rough estimate of their likely costs anywhere in England, Wales and Scotland based on their zoned pricing system, but for an accurate quote we recommend calling the company direct on 01985 844144 or emailing them at orders@martinbrosltd.com.

Introduction to our auctions

The Auctioneer acts only as an agent of the Seller (unless expressly stated otherwise). Accordingly, the seller is not required to pay until payment is received from the buyer, nor is the auctioneer necessarily able to know the history or assess the quality of the lots being sold on behalf of those principals. In addition, lots sold are likely to be subject to wear and tear caused by use or age and may therefore have defects and imperfections.

Buyers are given ample opportunity at the time of the viewing to see the lots to be sold and are deemed to have done so. They must rely solely on their own skill or judgment to determine whether lots are fit for purpose and whether lots match the description or images.

New conditions of sale

The following terms of sale, together with notices to buyers that may be displayed in the sales area or in the catalog, the seller's terms of sale on the back of the application form and the usual terms of sale displayed in the auction rooms, register for the auction. sale of any lot and each person who made a successful bid is considered binding:-

1. Course of the auction

1.1 The Auctioneer (which also includes its employees) is offering each Lot as an agent of the Seller and not as a client, unless otherwise stated in the catalog or at the time of sale.

1.2 A minimum price may apply to each lot. If the auctioneer under any circumstances sells the lot below the reserve price, he is free to cancel the sale, even if the lot has been paid for and delivered, and upon refund of the purchase price (if paid), neither the seller nor the auctioneer has any further liability to the buyer.

1.3 The seller or his representative or the auctioneer on his behalf can bid up to the minimum price for the lot even where there is no minimum price

imposed (but in no other case) on the seller to make an offer in person or through a representative.

1.4 The auctioneer may withdraw, split or combine lots at any time before the hammer falls.

1.5 The auctioneer may sell any lot privately before or after the auction.

1.6 The auctioneer may reject the offer at its own discretion and without giving reasons.

1.7 The buyer is the person who made the highest bid before the hammer fell or another person whom the auctioneer may consider to be a buyer without giving reasons.

1.8 Unless the auctioneer has confirmed in advance in writing that someone is bidding on behalf of a named client as an authorized agent, anyone bidding is deemed to be bidding on their own behalf as a client.

1.9 If the auctioneer has already confirmed in writing that someone is bidding on behalf of the named principal, that person warrants that he has the authority of his principal to make any bid he makes.

1.10 Neither the seller nor the auctioneer is bound by any subsale or assignment or division of the contract of sale and the highest bidder, so the buyer is solely responsible for paying the purchase price to the auctioneer.

1.11 The auctioneer may decide whether there is a dispute between the bids, resolve the dispute summarily or immediately re-offer the Lot for sale, in each case without giving reasons.

1.12 The auctioneer undertakes to ensure that descriptions are accurate and reliable, but they are necessarily matters of opinion only and should not be construed as statements of fact. Neither the seller nor the auctioneer is responsible for the accuracy of any lot description or its attribution in any way to a particular creator.

2. After the auction

2.1 When the auctioneer indicates that the lot has been sold, the Buyer shall, within the period specified in 2.2 below, a) pay for the lot or lots in full, together with all due VAT and all premiums plus VAT; b) the value, as summarily determined by the auctioneer, whose decision is final and binding, of all or part of the lot or the area where the auction is held, which was damaged or destroyed by the buyer or his client or his policeman.

2.2 The time for compliance with Article 2.1 is 2:00 p.m. on the day of the auction or at another time specified in the auction catalog.

2.3 The auction manager may at any time at his discretion grant the Buyer an extension of the deadline for compliance with clause 2.1.

2.4 As long as the Buyer does not fulfill clause 2.1 above a) ownership of the purchased plot does not pass to the Buyer; b) The Lot is at the Buyer's risk; c) The auctioneer has a right of lien on all lots purchased by the Buyer at the auction; d) if the Buyer agrees or intends to carry out a resale or any other disposal of all or part of the plot, the Buyer will keep the proceeds from the resale or other disposal safe for the Auctioneer and the Seller.

3. Removal of the purchased plot

3.1 The Buyer may not remove the Lot until he has paid in full the amounts specified in Article 2.1 for each Lot he has purchased.

3.2 After payment of the amount from Article 2.1, the Buyer must collect the purchased Lot before 2 p.m. on the day of sale or at the time specified in the catalog.

3.3 If the purchased lot contains a motor vehicle, it is not guaranteed that the vehicle can be driven safely or legally on the road.

3.4 Neither the seller nor the auctioneer shall be liable under section 6 of the Health and Safety Act 1974 and the Buyer undertakes to carry out all necessary tests, investigations and other works to ensure that each lot purchased is in the best possible condition. becomes safe. and without risk to health and safety at all times when used by any person at work.

4. Default obligations by the customer

4.1 If the Buyer has not paid the amounts specified in Article 2.1 after the expiration of the time specified in Article 2.2 or by the extension granted in Article 2.3, or has removed the lot within the time specified in Article 3.2, the auctioneer may cancel and dissolve that lot and that lot may be resold by auction or privately.

4.2 If the auctioneer has canceled the sale, but the buyer has removed the purchased lot, the auctioneer has the right, without prior notice, to enter all rooms where he believes the lot is located and remove it.

4.3 If the auctioneer has canceled the sale and the lot has been resold, the Buyer will make up any shortfall in the sale price less the resale price, together with the costs associated with the resale.

5. Liability and Indemnities

5.1 The auctioneer warrants that it believes that the seller of each lot is able to transfer title, and if the seller is unable to do so, it will make all reasonable efforts to assist the buyer in obtaining title and in pursuing any remedies the buyer may have against the seller. , but the auctioneer has no obligation to sue and has no other obligation towards the buyer.

5.2 The auctioneer claims no professional or other knowledge of any lot sold and each lot is sold as seen with all defects and errors or mistakes in description and all written or oral representations as to description, quality or suitability are excluded. 6. Disclaimers

Card offer

Prospective buyers are requested to complete a buyer registration form in our accounting department and collect a numbered offer card prior to the sale. Have the number handy when you bid, in case the lot sells to you. When you are done with the purchase, you must destroy the card. In case of loss, you must immediately notify accounting.

Absent offers

If you are unable to attend the sale, you can leave the offer in absentia by filling out one of the special forms available in accounting or in the salesroom. You must enter the lot number, description and the maximum price you are willing to pay. Please ensure that the lot number is correct and that you have provided us with your full address with at least one telephone number. We will do our best to buy plots for you as cheaply as possible, taking into account other bidders and minimum prices. The terms under which we accept absentee bids on a commission basis are set out in the absentee bid forms. One of our employees will be happy to let you know the estimated time when the plot can be sold, and we advise you to inquire later by phone whether you were successful.
